Acceptance of the terms
By accessing the dotarisportive.ro site and using the information published here, you confirm that you have read and accept these terms. If you do not agree with them, please do not use the site.
These terms apply together with the privacy policy and with the cookie policy.
The operator’s full fiscal identification details (legal name, unique registration code, trade register number and full registered office address) are published in this document. Until they are published, any communication regarding personal data, the terms of use or cookies is made through the e-mail address and telephone number given in the /en/contact-us/ section.
Terms used
- site – the dotarisportive.ro domain and all pages published on it;
- user – any person who accesses the site;
- operator – the site operator, trading under the brand Dotari Sportive;
- solutions – the products and equipment works presented on the site: seats, grandstands, reserve benches, media-area equipment, furniture and fit-outs for sports venues;
- offer – the technical and commercial proposal sent in writing, following a request;
- contract – the document signed by the parties or the order confirmed in writing by the operator.
Purpose of the site
The site is a presentation website for equipment solutions for stadiums, sports halls, training facilities and other sports venues. It is addressed to contractors, designers, public authorities and institutions, sports facility operators and other companies involved in sports infrastructure.
The site is not an online shop: orders cannot be placed directly from the published pages and there is no shopping cart. The information presented is descriptive and does not constitute a binding commercial offer within the meaning of art. 1196 of the Civil Code.
Permitted and prohibited use
You may browse, read and print the pages of the site in order to evaluate a collaboration with the operator. The following are not permitted:
- to copy, republish or resell the content of the site for commercial purposes without the operator’s written consent;
- to automatically collect data from the site (scraping) or to use tools that place heavy load on the server;
- to attempt unauthorised access to the administration area or to disrupt the operation of the site;
- to submit false data through the form, or illegal or defamatory content, or content that infringes the rights of others.
Content and intellectual property
The texts, photographs, graphic elements, page structure and the brand displayed on the site belong to the operator or are used under a right of use. Reproducing them without written consent is not permitted.
The names and trademarks of manufacturers or partners appearing on the site are used solely to describe the solutions available and belong to their owners.
Information about the solutions presented
Photographs and graphic representations are indicative. Colours, textures and finishes may differ depending on the production batch, screen settings and the lighting conditions on site.
The dimensions, materials, standards and other technical characteristics that apply to a project are those stated in the offer submitted and in the technical documentation annexed to the contract. Information on the site may be updated without prior notice.
Quote requests and formation of the contract
The contact form, e-mail and telephone calls are ways of sending us a request. Sending a request does not constitute an order and does not create an obligation to deliver.
On the basis of the information received we prepare a technical and commercial offer, sent in writing, with the validity period stated in the document. The contract is concluded when the client accepts the offer and the operator confirms the order in writing, or when the contract is signed, as the case may be.
In the case of public procurement, the contract is concluded under the conditions laid down by public procurement legislation and by the award documentation, on the basis of the offer submitted in the electronic system.
Prices
Prices are quoted individually, in the offer, depending on configuration, quantity, materials and delivery and installation conditions. The currency, the applicable rate of value added tax and any separately stated costs (transport, installation, preparatory works) are indicated in each offer.
The offer is valid for the period stated in the document. After that period expires, prices may be reconfirmed.
Delivery and installation
Delivery and installation deadlines are set in the offer or in the contract, depending on the configuration ordered and on the progress of works on site. For delivery and installation to run smoothly, the site must be accessible and prepared in accordance with the conditions stated in the offer.
Acceptance of the works is carried out in accordance with the contractual documents, by checking quantities, installation and operation, in the presence of the parties’ representatives.
Warranty
Warranty periods, the conditions for granting them and the intervention procedure are those stated in the offer, in the contract and in the manufacturers’ technical documentation.
The warranty does not cover normal wear, damage caused by improper use, work carried out by third parties without the operator’s consent, modifications made to the products, or events outside the operator’s control. Claims regarding delivered products are submitted in writing, at the contact address, together with a description of the problem and, where possible, photographs.
Liability
We make every effort to keep the published information accurate and up to date, but we do not guarantee the absence of any drafting or display error. The specifications that apply to a project are those in the offer and in the contract.
We are not liable for interruptions to the site caused by maintenance work, by the hosting provider or by events beyond our control, nor for decisions taken solely on the basis of information on the site, without prior consultation with our team. The operator’s liability is limited to direct damages provided for by law and by contract.
Force majeure
Neither party is liable for failure to perform obligations caused by a reasonably unforeseeable force majeure event, such as natural disasters, epidemics, measures taken by authorities or prolonged disruption of transport networks. The affected party notifies the other within a reasonable time, and contractual deadlines are extended by the duration of the event.
Privacy and cookies
How we process personal data is described in the privacy policy, and how we use cookies is described in the cookie policy.
Complaints
If you are dissatisfied with the site or with a request sent through the site, please write to us at contact@dotarisportive.ro, describing the situation. We reply in writing, within the deadlines set by law, and if the matter is not resolved this way you may turn to the legal dispute resolution mechanisms.
For complaints regarding products and services purchased, you may /en/contact-us/ the National Authority for Consumer Protection, using the form available at anpc.ro. For commercial disputes between professionals, the route is the one set out in the contract.
Governing law
The relationship with users of the site is governed by Romanian law. Any disagreements are settled amicably and, where that is not possible, by the competent courts at the operator’s registered office.
Changes to the terms
We may update these terms when the services, commercial conditions or legal requirements change. The applicable version is the one published on this page, and the date of the last update is shown at the start of the document. The specific conditions of a collaboration are those in the offer and in the signed contract.
